Vince Barbera represents businesses of all sizes and pursuits, as well as individuals, in the litigation of commercial and business disputes in court and through arbitration. 

He focuses his practice on prosecuting claims and defending clients in a wide variety of business litigation matters, including those involving the enforcement of restrictive covenants, unfair competition and other business torts, intellectual property disputes, partnership and shareholder disputes, real estate disputes, professional liability claims, and various contract-based actions. He has tried both jury and non-jury commercial cases to verdict and has argued commercial cases before federal and state courts in Pennsylvania and New Jersey. Vince has also successfully represented clients in appellate matters before the Pennsylvania Superior Court and the United States Court of Appeals for the Eighth Circuit.

The diverse nature of Vince's practice provides him with a unique perspective when advising and counseling clients towards reaching the best and most cost-effective resolution to their legal issue.

Representative Matters

  • Leonetti’s Frozen Foods, Inc. v. Crew, Inc., 887 F.3d 438 (8th Cir. 2018)  Briefed and argued appeal of adverse summary judgment decision before the United States Court of Appeals for the Eighth Circuit, resulting in the reversal of the District Court’s decision in favor of a locally-based food manufacturing company. A seven-figure settlement was thereafter obtained for the client.

  • Lead trial counsel in Pennsylvania state court in four-day jury trial in breach of contract matter. Jury verdict for full amount of client’s claim. 

  • Defended home health care company accused of trademark infringement. Plaintiff ultimately agreed to a walk-away settlement.

  • Lead trial counsel in five-day jury trial of complex commercial dispute in Pennsylvania state court
  • Obtained injunction in favor of corporate client enforcing terms of non-solicit provision, and later moved for and secured award of sanctions against opposing parties for violating the terms of the injunction order
  • Briefed and secured Rule 12(b)(6) dismissal of Dragonetti and abuse of process claims against attorney client in Federal Court

  • Secured preliminary injunction requiring corporate director to take action consistent with prior vote in favor of board resolution
  • Obtained injunction for corporate client to enforce terms of non-compete and other restrictive covenants in Philadelphia Commerce Court
  • Secured summary judgment in favor of corporate client which was upheld on appeal by the Pennsylvania Superior Court
  • Represented shareholders of closely-held corporations in shareholder oppression litigation in the Chancery Division of the New Jersey Superior Court
  • Represented corporate client in challenging a confession of judgment and negotiated and secured a favorable settlement
  • Successfully tried commercial cases for individual and corporate clients in Pennsylvania courts’ compulsory arbitration program
  • Litigated property damage and collection matters on behalf of individuals and corporate entities which resulted in judgments in favor of clients 

Recognition & Involvement

While in law school, Vince was a member of Villanova Law School’s National Trial Team where he competed in the final trial to win the 2008 Lone Star Classic, a national invitational mock trial tournament in San Antonio, Texas. From 2009 - 2016, Vince served as a member of the Adjunct Faculty at Villanova Law School and coached the National Trial Team. 

He also provides pro bono legal advice and counsel through Philadelphia V.I.P. and Philadelphia Volunteer Lawyers for the Arts, a non-profit legal services organization that offers legal assistance to artists as well as arts and cultural organizations. 

Vince is actively involved in the Philadelphia legal community. In 2018, he served as Chair of the Executive Committee of the Young Lawyers Division of the Philadelphia Bar Association. He currently serves as a member of the Board of Governors of the Justinian Society and of the Board of Directors of The Lawyers' Club of Philadelphia. Vince was selected in a survey of his peers as a Pennsylvania "Rising Star" by Super Lawyers from 2014-2019.
