Mediation Leads To Seven-figure Settlement Involving Liability And Excess Insurers

Ben Staherski, a partner in the Subrogation Department, recently obtained a $1.6 million settlement shortly after mediation. The settlement involved the participation of the liability and excess carriers for the defendant roofing contractor. In this case, the roofing contractor was hired by a commercial building owner to re-roof its building. The insured operated an appliance and electronics store out of the building. While the roofing work was being done, a significant storm came through the area and flooded the store. Our investigation determined that the temporary sealing of the roof was not adequate. Thus, Ben filed suit against the roofing contractor, alleging that the defendant filed to take the necessary steps to protect the store from water intrusion during the completion of its work. Ben’s aggressive pursuit of the defendant ultimately resulted in the favorable settlement of this matter.
