OVERVIEW
Morgan Birch focuses her practice on representing clients in commercial litigation matters and complex business disputes. An experienced advocate, Morgan has significant experience managing all phases of litigation in state and federal courts around the country — from pre-litigation strategy through appeal. Her diverse practice includes a wide variety of litigation matters, including breach of contract, intellectual property and trade secret claims, fraud and breach of fiduciary duty, partnership and shareholder disputes, restrictive covenant matters, commercial real estate disputes, and data privacy cases. Morgan’s experience also includes successfully defending corporations against state and federal investigations and related litigation pertaining to challenges of commercial business practices.
Morgan routinely advises and provides guidance to clients on issues surrounding large scale e-discovery collection and management. She has diverse experience conducting complex document analysis and productions in high-exposure litigation in state and federal courts.
Prior to attending law school, Morgan acquired valuable governmental and legislative experience, working for the Mayor of the City of Philadelphia.

While in law school, Morgan was selected as a Marshall Brennan Constitution Law Fellow, which afforded her the opportunity to teach constitutional law and appellate advocacy to Philadelphia high school students.

REPRESENTATIVE MATTERS
- Secured total defense victory at trial and a multimillion-dollar fee award for a publisher falsely accused of deceptive sales practices by the Federal Trade Commission and the Pennsylvania Office of Attorney General.
- Appointed as a Special Master in the In re Generic Pharmaceuticals Pricing Antitrust Litigation muti-district litigation.
- Successfully secured favorable settlements for five separate technology companies who were sued by a leasing and financing company following the collapse of a global cloud computing network company, significantly minimizing exposure.
- Represented a shareholder of a commercial and residential construction firm in a dispute involving allegations of fraud, theft, misappropriation of assets, breach of fiduciary duty, successfully negotiating a favorable settlement which saved the business from a liquidation sale.
- Represented a former employee of a medical services provider in a restrictive covenant dispute, successfully negotiating the exclusion of all restrictive covenant obligations under the parties’ agreements.
- Obtained a complete judgment, including costs and attorney’s fees, in favor of a financing lender against a distilling company arising from a default under the terms of the financing partners’ promissory notes.
