Subrogation Department Negotiates Seven-figure Settlement

Ben Staherski, a Partner in the Subrogation Department, recently negotiated a $ 1.1 million settlement in the days leading up to trial. The loss at issue related to a construction defect associated with a failed solder joint that separated in a Philadelphia high-rise approximately 1.5 years after the building was constructed. After the joint failed, a small leak was detected and multiple parties were involved with the discovery of the leak and repairs to the pipe that failed. However, none of the parties involved made a permanent repair to the joint before it separated and caused a flood. Prior to settling the matter, Ben had to navigate numerous contractual impediments and ended up suing solely the mechanical subcontractor who installed the pipe. The mechanical subcontractor, in turn, brought in three third-party defendants who Ben’s client was barred from pursuing. After taking numerous depositions, including expert depositions, and successfully defeating multiple pre-trial motions, Ben was able to favorably settle this matter.
