The multi-billion-dollar online marketplace industry continues to strongly resist responsibility for defective products that injure people and damage property. When a product’s manufacturer, distributor and/or seller are located overseas and are not subject to legal process, pursuing product liability claims is complicated. In addition, because entities in the chain of distribution are located overseas, the plaintiff is often left without a target defendant other than the product’s online marketplace/seller. This webinar will review the online retailer business model, the legal defenses the industry traditionally asserts to defeat product liability claims, and recent court decisions that directly impact the viability of legal claims when a product is sold over the internet.
