Like other organizations, law firms are now held to stringent data privacy and security standards imposed by law, contracts, and even ethical obligations. An increasing number of laws, such as New York’s SHIELD Act and the California Consumer Privacy Act (CCPA) regulate firms directly; while clients, who may view law firms as significant risk vectors, obligate firms to satisfy rigorous data security requirements, sometimes with strict indemnity provisions, in counsel guidelines and data security agreements. Professional rules of responsibility also require firms to undertake affirmative steps to protect client data and information systems. The panel will discuss these obligations and address how law firms of all sizes may comply with them.
