The presentation will provide attendees with a basic understanding of the elements of a negligence claim – duty, breach, causation and damages, as well as discuss a number of topics, including:
- Standards of care – which create the duty element.
- Sources of a duty for tradespersons, such as codes and standards.
- The foreseeability factor, which is critical when assessing causation.
- A brief overview of the measure of damages and the common misconception about Actual Cash Value being the recoverable amount of damages.
