OVERVIEW
Sara Mirsky concentrates her practice in the area of complex insurance coverage litigation and insurance contract disputes. She primarily represents major insurance carriers in matters involving exposure to asbestos and long-tail environmental matters in state and federal courts. Sara also has extensive experience in evaluating coverage for and litigating on behalf of primary and excess insurers in court and arbitration. Sara’s diligence and attention to detail have made her a key player on small teams and in larger joint defense groups.
Sara has experience litigating a multitude of insurance issues, including coverage allocation among triggered insurers, defense obligations for various types of policies, and the interpretation of policy exclusions. Sara has also done extensive work on cases involving late notice issues, questions regarding policy cancellations and a policy’s scope of coverage. She also worked on several cases involving policyholders that sought injunctive protection through Section 524(g) of the Bankruptcy Code.
While in law school, Sara served as the Editor in Chief of the New York Law School Law Review. Sara was also an intern in the White House’s Open Government Initiative, which was run through the Office of Science and Technology Policy. Prior to attending law school, Sara worked as a paralegal. She also spent a year working at the venerable Murray’s Cheese Shop in New York City.

Sara received a 2021 Best Lawyers "Ones To Watch" recognition for her work in Insurance Law.
Sara regularly volunteers at clinics held by the Senior Law Center to assist seniors in the preparation of life-planning documents including simple wills and powers of attorney. Working in tandem with the Public Interest Law Center, Sara helped draft a memo to the Census Bureau regarding the addresses used for individuals in jail or prison on Census Day. She also advocated on behalf of a veteran seeking benefits for PTSD-related injuries.

REPRESENTATIVE MATTERS
- Obtained a summary judgment ruling on behalf of a major insurance company in an action brought in the Northern District of New York by an energy services provider seeking past and future costs related to 22 former manufactured gas plant sites
- Led a team through extensive discovery in a manufactured gas plant action in the Northern District of New York
- Served on a large trial team in a month-long trial in Delaware State Court and assisted a team of insurers against policyholders seeking coverage for hundreds of millions of dollars in asbestos-related damages
- Achieved a dismissal on behalf of several insurance companies in an action involving hundreds of millions of dollars in remediation for a hazardous waste site in northern New Jersey
- Evaluated coverage for claims filed under dozens of complex policies and drafted related disclaimer letters on insurer’s behalf
