Randy Friedberg has over 30 years experience in counseling clients, with particular focus on the protection, licensing and enforcement of intellectual property rights. His practice encompasses trademark and copyright law, unfair competition, trade secrets, advertising matters, internet and cyber matters, rights of privacy and publicity, and entertainment law, as well as general corporate and litigation matters.
Randy represents clients in a variety of industries for corporate work and litigation before a wide range of state and federal courts, in the United States Patent and Trademark Office and before the Trademark Trial and Appeal Board, including consumer goods and services, computer software and hardware, pharmaceutical and biomedical products, non-profits, media, entertainment, and energy and financial services.
Randy is a frequent source for the news media. He has been on NBC News and is regularly quoted in the press. He is also asked to speak and present at business-related events and for CLE programs, including Lawline and Clear Law Institute, among others. Randy has also served as a Judge for the Cardozo Entertainment Moot Court Competition.
Randy is the author of “Navigating Intellectual Property Disputes,” an authoritative, insider's perspective on assisting clients with managing IP assets and litigating disputes. He is a member of the International Trademark Association and of The Recording Academy, and was on the editorial subcommittee of The Trademark Reporter, a publication of the International Trademark Association.
In 2019, Randy was appointed Chair of the Entertainment Law Committee of the New York City Bar Association. Randy previously served as the primary drafter of the New York City Bar Entertainment Law Committee report titled "Report Supporting Amendments to the Definition of "Theatrical Employment Agency" as Proposed by the NYS Bar Association Entertainment, Arts and Sports Law Section."
Representative Matters
- Represented Stadium Goods, a streetwear and sneaker resale store and e-commerce site, as intellectual property counsel in its multimillion dollar sale to Farfetch Limited, a publicly-traded global technology platform for the luxury fashion industry
- Represented Stadium Goods, a streetwear and sneaker resale store and e-commerce site, in its backing from LVMH Luxury Ventures
- Represented several famous clothing and accessories designers and companies in a variety of intellectual property, corporate and litigation matters, including “bet the company” arbitration and litigation
- Outside general counsel to one of the largest pet toy companies in the country; engaged in trademark, copyright, and patent registration, licensing and litigation, as well as Proposition 65 litigation and general corporate matters
- Negotiated and drafted a wide variety of software and SaaS agreements for both licensors and licensees
- Assisted client in providing a secured, tranched bridge loan to a SaaS-based technology company delivering online and mobile interactive health management platforms
- Outside general counsel to advertising agencies and media companies
- Counseled several food product companies on intellectual property and labeling issues
- Defended food product company in connection with a class action false advertising lawsuit
- Advised clients on cyber-policies and breach response
- Drafted numerous terms of use and privacy policies
- Represented a large private label manufacturer and distributor of cosmetics for trademark, copyright, online and general commercial matters
- Represented national modeling agency in connection with FTC and other matters
- Represented numerous licensors and licensees in negotiating and drafting significant license agreements in a wide range of industries, including clothing, music, television, software and cosmetics
Recognition & Involvement
Since 2007, Randy has been selected for inclusion in ”Super Lawyers” in the New York Metro Region for intellectual property in a survey of his peers.
