Marc helps his clients to achieve their business objectives, manage risk, and resolve disputes. He regularly advises individuals and businesses on the nuances of Delaware commercial and business entity law, corporate governance, shareholder rights, partnership conflicts, employment issues, and commercial real estate transactions. He is also experienced in all aspects of corporate restructuring, reorganization and bankruptcy matters.

In addition to trial experience in all Delaware State and Federal Courts, Marc represents clients in alternative dispute resolution proceedings, including arbitration and mediation, as well as proceedings before administrative bodies such as the EEOC and Delaware Department of Labor. He is often trusted by insurers to handle complex insurance coverage claims, defend insured parties under third-party liability policies, and litigate insurance professional error and omission claims.

  • Obtained defense verdict for employer in federal jury trial in FMLA retaliation case
  • Secured full recovery for general unsecured creditor client group as co-counsel for Official Committee of Unsecured Creditors of debtor Phoenix Payment Systems, Inc.
  • Member of deal team for transaction of iconic hotel property in Wilmington, Delaware
  • Obtained Trial Court decision that faulty workmanship was not an occurrence triggering coverage under contractor's CGL policy
  • Obtained Trial Court decision that insurer had no obligation to defend contractor or subcontractor employer of a worker suffering catastrophic injury at a construction site
  • Obtained defense verdict for service station client in jury trial over catastrophic injuries to patron injured on premises
  • Obtained a favorable decision from the Delaware Supreme Court in a suicide case regarding legal duty by a school with respect to student injury that occurs after the student leaves the school
  • Obtained first-impression trial court interpretation of the recently enacted Delaware Bullying Prevention Act in favor of school clients
  • Obtained dismissal of a coach's premises liability claim against a private school in the Superior Court of the State of Delaware
  • Obtained motion to dismiss a student's complaint for unconstitutional disciplinary process against a community college before the United States District Court for the District of Delaware
  • Obtained summary judgment on a professor's tenure denial complaint against a university before the United States District Court for the District of Delaware

  • Obtained summary judgment on a student's complaint for unconstitutional expulsion against a university before the United States District Court for the District of Delaware
  • Defended a variety of employment discrimination claims brought before the EEOC and Delaware Department of Labor 

Recognition & Involvement

Marc is the Pro Bono Coordinator for the Delaware office. He regularly donates time each year to assisting pro bono clients through the Office of the Child Advocate and similar organizations.

In his spare time, Marc volunteers at a no-kill animal shelter near his home.
