Justin Proper is a partner in the Commercial Litigation Group. He has extensive experience representing client’s in all aspects of complex commercial litigation and represents financial services, telecommunications, high technology and retail companies in real estate, intellectual property, employment, and contract/business-tort matters. 

Justin has substantial first-chair trial and arbitration experience, including 13 verdicts in his client’s favor in 14 jury trials. In the last four months of 2011 alone, Just was lead counsel in three matters which resulted in jury verdicts for his clients totaling $4.275 million. Justin also recently obtained a liability verdict from a Philadelphia jury in a bifurcated matter involving the breach of a restrictive use provision in a commercial lease. The defendant had successfully tried the same issue to verdict in a number of other jurisdictions and it was the first victory of its kind in the country.  

Justin has particular capability litigating unfair competition and false advertising claims under the Lanham Act, as well as claims under the patent, copyright and trade secret laws. In one case, he successfully defeated a motion for a preliminary injunction in federal court which sought to declare that the client was selling an infringing product. The court found that the product did not infringe the patent in suit and that the plaintiff failed to prove either a likelihood of success on the merits or irreparable injury. The decision was affirmed on appeal by the United States Court of Appeals for the Federal Circuit.   

Justin is currently involved with multiple cases involving the alleged misappropriation and/or infringement of intellectual property, including the alleged violation of the Lanham Act and copyright laws relating to the unauthorized sale of a competing cookbook; the alleged misappropriation of trade secrets by a major telecommunications provider; the alleged misappropriation of trade secrets by a worldwide producer and seller of medical instruments and devices; and the alleged infringement of multiple patents relating to the production and sale of a facsimile that allegedly can be coupled to a computer via an interface circuit and used as a printer or scanner.   

Justin’s experience having arbitrated and tried hundreds of cases in the last 15 years allows him to properly advise his clients on the strengths and weaknesses of their individual case. He takes tremendous pride in the successes he has obtained for his clients, and for always being responsive to their needs, day or night.       

Justin has extensive experience representing both plaintiffs and defendants. He also has significant experience handling fraud based claims. Justin has been lead counsel in more than 30 bench and jury trials and has never lost a jury trial where he has been lead counsel. In one four month period in 2015, he was lead counsel in three complex commercial litigation matters which resulted in jury verdicts for his clients totaling $4.275 million, two of which included awards of punitive damages. In 2019, a Florida jury returned a verdict for Justin’s client on claims for fraud and violations of the Florida Deceptive Trade Practices Act in the amount of $430,000, which included punitive damages of $300,000. Later in 2019, a New Jersey jury awarded Justin’s client $310,000 in a lease dispute with a commercial landlord involving property taxes and environmental costs. Justin also successfully tried a case in Rome County, Georgia where the trial court found that the defendants violated the Georgia Deceptive Trade Practices Act. The court awarded his client injunctive relief and $50,000 in punitive damages. The case was recently affirmed on appeal.

Justin handles all of his cases with the same passion and energy. He believes that success in litigation happens before you ever walk into the courtroom. Justin has a proven track record of handling cases successfully having arbitrated and tried hundreds of cases. He prides himself on being accessible to his clients; in giving his clients sound advice; and in working tirelessly to achieve his clients’ objectives. Recognition & Involvement

Justin loves all sports but he has a particular passion for basketball. For the past 8 years, he has coached various girls travel basketball teams and provides year-round training. Justin’s teams have competed at regional and national AAU tournaments.
