For over 25 years, Ellen Burrows has successfully represented insurers and reinsurers in the litigation and arbitration of complex coverage matters. Her arbitration and litigation experience includes asbestos, environmental and other long-term exposure claims, mass disasters, and issues including follow-the-form and follow-the-fortunes issues, application of aggregate extension clauses and the accumulation of claims, pro-ration of retentions and deductibles in multi-year policies, clash cover, extra-contractual coverage and Bellefonte issues. Ellen has counseled insurers and reinsurers in various complex cases with respect to audit issues and has drafted complex international treaty program wordings. 

Ellen has designed and implemented audit programs for both insurers and reinsurers with respect to substantial professional liability (accountants and attorneys) and contractors liability books of business. Her background includes evaluating complex claims and positioning them to obtain optimal reinsurance and/or retrocessional recoveries on behalf of clients. She additionally assists clients in the implementation of settlement agreement details, including addressing billing and payment issues.

Ellen has been a regular speaker at reinsurance and insurance industry conferences and has written articles for various industry publications.

While in law school, Ellen was a Note and Comment Editor of the Temple Law Review. She is a member of ARIAS-US and has served as a reinsurance arbitrator. Ellen has also served as an arbitrator for the NYSE and the NASD and has received extensive mediation training from the Center for Public Resources (CPR). In addition, she assisted in drafting CPR rules for the inter-company mediation of coverage disputes.

  • Represented property and casualty insurance company in recovery claims of asbestos products and non-products claims under various treaty and facultative wordings
  • Successfully opposed petition to vacate reinsurance arbitration award in a clash cover case in the Ninth Circuit
  • Represented property and casualty insurer in collecting reinsurance claims arising out of Liberian Civil War
  • Counseled property and casualty insurer on coverage issues arising out of San Juan DuPont Plaza Hotel fire
  • Represented mortgage insurer in MDL litigation involving $1.2 billion in defaulted mortgage loans
  • Advised major property and casualty insurance company on treaty wordings implementing global reinsurance program arising out of assets transfer
  • Represented property and casualty insurer in reinsurance arbitrations arising out of the Wellington Agreement for the handling of asbestos claims
