Brett Tishler practices exclusively in the field of property and workers’ compensation subrogation throughout the United States. Brett represents a variety of major insurance carriers and individual claimants to secure complex recoveries in cases involving product liability, negligence, construction accidents, and premises liability litigation. In addition to recovering past liens in workers’ compensation subrogation cases, Brett often negotiates the closure of future workers’ compensation benefits in a global settlement.
Brett is known for approaching cases from all angles in order to find creative and effective methods of resolution. While a primary goal is to resolve cases in an efficient and cost-effective manner, Brett examines each case with the expectation it will go to trial and is therefore always fully prepared. He is committed to achieving the best results for his clients and handles all aspects of litigation, including client counseling, initial case assessment, discovery, motions/oral argument, trial and settlement.
Outside the courtroom, Brett frequently meets with insurance companies and employers in order to discuss various issues involving workplace accident and injury investigations. Such activities include providing training presentations or identifying workers' compensation subrogation issues and exploring all avenues of recovery. Brett is also frequent lecturer for the National Association of Subrogation Professionals (NASP).

Representative Matters
- Litigated four-week motor vehicle trial in North Carolina involving the death of one of the insured’s employees and significant injuries to another; at the conclusion of the trial, secured a favorable verdict resulting in a 100% recovery of the subrogating insurer’s $630,000 worker’s compensation lien
- Negotiated settlement in excess of $1 million dollars in a complex products liability case filed in Pennsylvania Federal Court against an agricultural manufacturer for injuries involving an arm amputation while operating 40-year old farm equipment
- Negotiated settlement of $750,000 dollars in a products liability case filed in Pennsylvania against supplier of laundry press for injuries involving significant third-degree burns sustained when press closed down on top of operator
- Continued success in securing recoveries through New York Loss Transfer law, which involves statutory limitations on third-party recoveries

- Continued success in obtaining favorable awards through Arbitration Forums
- Successfully mediated reimbursement of workers’ compensation liens employing global resolutions and Medicare Set Asides
Recognition & Involvement
Brett was selected in a survey of his peers as a Pennsylvania "Rising Star" by Super Lawyers from 2015-2019
Since 2007, Brett has served as an arbitrator for both the Philadelphia Court of Common Pleas and Eastern District of Pennsylvania.
