Brandon Arber represents national and international corporations in high-stakes complex litigation. His experience includes complex commercial business disputes, class action, toxic tort, product liability and employment litigation. He also represents insurers in bad faith and coverage disputes.

Brandon has assisted both publicly traded Fortune 50 companies and small, closely held businesses in contract and business disputes. He has drafted insurance coverage opinion letters assessing coverage under CGL and Homeowners Insurance policies as well as represented employers and employees in employment discrimination and wage and hour matters in the MCAD and Massachusetts Superior Court. He has represented clients in all phases of litigation, from initial counseling, through discovery, to mediation, trial, and appeal.

Representative Matters

  • Defeated effort to certify a $4 billion class of all Massachusetts school districts having buildings with elevated airborne PCB levels. Case subsequently dismissed on summary judgment after three years of extensive litigation in federal court in Boston
  • Drafted successful appellate brief for the United States Court of Appeals for the First Circuit on behalf of insurer in declaratory judgment and bad faith coverage action arising from an accident at a charity which resulted in serious personal injuries
  • On the eve of trial, obtained favorable resolution of racial discrimination and retaliation claims in case where the president of a local college had allegedly told the plaintiff she would not consider him for an open senior administrative position because he was a person of color

Recognition & Involvement

Brandon taught an 11-week course on constitutional law to a group of middle school students in Boston for Discovering Justice: The James D. St. Clair Court Education Project. Brandon attended the April 2012 ABOTA and ABA Trial Trial Academy mock trial program. He is a graduate of the Anti-Defamation League’s Glass Leadership Institute. As a part of a firm pro bono program, he spoke to high school students and parents across Massachusetts about the social host laws and potential civil liability related to underage drinking, as well as to scholastic sports organizations regarding potential civil liability from sports-related concussions. Brandon is an avid rugby player and assisted his amateur club in successfully achieving 501(c)(3) tax-exempt public charity status with the IRS.
