White and Williams Secures Trial Victory in Breach of Contract Action

After a four day non-jury trial, the Philadelphia Court of Common Pleas found in favor of our client, a College, in a breach of contract action. The Plaintiff, a former student, claimed that the College failed to follow its own procedures in a conduct hearing that resulted in his dismissal from the College.

The Court found that the College "substantially complied" with its procedures and that the Plaintiff waived his claims because he failed to raise many of his complaints during the student conduct hearing and in his appeal to the College president. Additionally, the Court found that the "Plaintiff's testimony before [the] Court was replete with falsehoods and misstatements and his claim of damages...was not credible."
