Robert Carlton’s practice is focused on fidelity and surety law, construction claims litigation, construction contracting, construction contract drafting and insurance litigation.
Bob has over 30 years experience in counseling and representing clients in regards to all aspects of suretyship, including drafting takeover and completion agreements, managing defaults and takeover situations, prosecuting indemnity actions, defending payment and performance bond claims and defending bad faith claims against sureties. Bob’s experience also includes litigating delay and disruption, inefficiency and extra work claims. He has also litigated claims involving check forgery and check kiting for insurers and financial institutions.
Bob has written and lectured on construction and surety topics at CLE programs for the Pennsylvania Bar Institute, the National Business Institute and the Fidelity and Surety Law Committee. Bob was recently appointed as Vice President and Director of the Philadelphia Surety Claims Association.
Representative Matters
- Represented a subcontractor in litigation of a delay and disruption claim against the general contractor and its surety on a project involving the reconstruction of the Schuylkill Expressway from Market Street through South Street in Philadelphia
- Represented employee benefit funds in litigation against an employer’s payment bond surety
- Represented a general contractor in a law suit against a surety’s reinsurers, vindicating the general contractor’s right to bring suit directly against the reinsurers
- Represented numerous sureties in actions to recovery indemnity from bond principals and individual indemnitors
