Marc Casarino counsels clients in all phases of litigation and risk management. In addition to trial experience in all Delaware State and Federal courts, he regularly represents clients in alternative dispute resolution proceedings, including arbitration and mediation, as well as proceedings before administrative bodies such as the EEOC and Delaware Department of Labor.
A significant portion of Marc’s practice is devoted to representing educational institutions with respect to employment litigation, tenure and promotion considerations, student discipline, student disability accommodations, campus security and Constitutional and civil rights disputes. His experience also includes labor and employment advice, contract negotiation and disputes, commercial real estate concerns, creditor claims, corporate governance, shareholder rights and partnership disputes. He is approved by national and regional insurers to handle complex insurance coverage claims, defend insured parties under third-party liability policies and litigate insurance professional error and omission claims.
Clients call upon Marc to conduct internal investigations of discrimination and harassment complaints, as well as to generally audit compliance with applicable laws and regulations. In this regard, Marc presents employee and management training seminars to keep clients abreast of changes in the law and to assist with compliance requirements.
Marc frequently lectures to clients and industry professionals with respect to his practice areas.
Representative Matters
- Obtained motion to dismiss a student's complaint for unconstitutional disciplinary process against a community college before the United States District Court for the District of Delaware
- Obtained dismissal of a coach's premises liability claim against a private school in the Superior Court of the State of Delaware
- Obtained summary judgment on a professor's tenure denial complaint against a university before the United States District Court for the District of Delaware
- Obtained summary judgment on a student's complaint for unconstitutional expulsion against a university before the United States District Court for the District of Delaware
- Defended an administrative agency's investigation of Title IX violations at a university
- Defended a variety of employment discrimination claims brought before the EEOC and Delaware Department of Labor
