Kimberly Hendrix Scheidt counsels general liability, professional liability and life, health and disability insurers on a variety of coverage issues, including claims resolution and bad faith. She also represents insurers in all aspects of litigation, including declaratory judgments, interpleader suits, class actions and other complex cases. Some of the coverage issues that she handles include construction defects, advertising injury and errors and omissions for a wide range of professionals.
Kim has a wide range of experience in complex insurance coverage and commercial litigation matters. She has served as litigation counsel for public and private companies, government agencies and not-for-profit organizations in a broad range of business and commercial disputes, including matters involving defamation, breach of contract, regulatory compliance issues and the defense of professional liability and products liability claims.
Kim has spoken about insurance coverage matters at industry meetings and client training sessions, and has served as a continuing legal education instructor on insurance issues.
Prior to joining White and Williams, Kim served as Corporate Counsel to an $86M national accounting firm, where she had primary responsibility for contractual matters for the firm’s 27 offices and 500 employees, as well as for providing legal support for various company functions and for the company’s litigation matters, its insurance and risk management plan and its program for compliance with applicable state and federal regulations. Kim worked directly with the General Counsel, CFO, COO and other senior executives on legal projects of special concern and trained staff and new managers on diverse legal issues.
Kim began her legal career as an attorney with a major Philadelphia firm, where she was a member of its Insurance and Professional Liability practice groups and was selected by firm management to play a key role in the recruitment, hiring, assignment and evaluation of new lawyers.
During law school, Kim clerked for the Hon. Robert J. Shenkin, Court of Common Pleas of Chester County, PA.
Representative Matters
- Secured judgments for professionals/companies in professional negligence and third party liability claims and negotiated favorable settlements of malpractice actions
- Counseled global computer manufacturer and financing agency on more than two dozen Pennsylvania customer disputes involving warranty/repair issues, financing arrangements, and unfair trade practices claims, including successful settlement or trial of disputes
- Defended leading national health and casualty insurers through judgment/settlement in numerous coverage and liability matters, including coordination of efforts by local counsel
- Won judgment for nursing home in action related to governmental reporting regulations.
- Prepared successful federal defendant class certification memorandum in case seeking declaration that national insurer was not obligated on $71M in insurance policies for claims arising from pharmacist’s drug dilution scheme
- Obtained judgment for government agency in multi-million dollar action involving pharmacy reimbursement rates under Medical Assistance program pursuant to Title IX of Social Security Act
- Represented regional hospital system in ADR proceeding over multi-million dollar contractual rates dispute with insurer
- Represented biotech company in settlement of contractual dispute over development of generic drug formulation
- Defended warranty and defective product claims for manufacturers of electronic, mechanical, industrial and medical goods (computer, treadmill, train brake shoes, latex glove, breast implant)
- Drafted and negotiated contracts essential to firm’s operations and provision of services to financial, chemical, manufacturing, energy, healthcare, technology, entertainment, communications and government clients
- Prepared and revised Firm policies on diverse topics including ADA, ADEA, Title VII, FMLA Leave, Auto Rental, Disaster Recovery Plan, Small & Diverse Business Plan, and Stay Bonuses
- Reviewed sales/marketing materials, prepared legal/compliance portion of firm’s Responses to client Requests for Proposal (RFPs) and conducted final review of firm’s responses to RFPs
- Conceived and prepared joint defense team brief that secured dismissal of $270M coverage action
- Advised clients concerning insurance regulatory issues, risk management, claims handling and claims denials and regulatory concerns, including advising a national flood insurer in connection with federal funding questions arising out of Hurricane Katrina
- Provided legal review and analysis of contractual provisions including non-competition, solicitation, indemnity, limitation of liability, insurance requirements, personnel standards, confidentiality, intellectual property, pricing and data security
- Prepared corporate amendments documenting firm real estate & investment business transfers valued at $5-10M
- Conducted review of clients’ contractual insurance requirements and prepared comprehensive database and an overview insurance summary for General Counsel and Chief Operating Officer
Recognition & Involvement
In addition to her law practice, Kim volunteers her time with the Duke Alumni Club of Philadelphia. During her four years as the club’s President and 12 years on the Board, she was instrumental in recruiting new Board members and rejuvenated membership participation by implementing creative programming and collaborating with other university alumni groups. Additionally, Kim is a member of the West Chester community concert band and performs in the flute/piccolo section.
