- Third Circuit Clarifies Azzarello and the Admissibility of Risk-Utility Evidence

Jerry Anders has 30 years experience in litigation and trials involving personal injuries, construction defects, product liability, premises liability and negligence. As Co-chair of the Construction and Surety Practice Group, he works with engineers, architects, developers, contractors and sub-contractors to resolve issues involving construction, contracts, building products, soil engineering, stucco and water intrusion.
Jerry also has significant experience in trying product liability cases and has handled claims involving cranes, bulldozers, loaders, trucks, automobiles, aircraft, conveyors, hoists, pumps, lifts, and consumer products. He has also handled significant cases involving design claims, warnings and crashworthiness. Jerry regularly advises and represents manufacturers, primary insurance carriers and excess insurance carriers in catastrophic cases and bad faith claims.
In addition, Jerry has successfully handled to conclusion or tried commercial cases and contract cases involving steel tubing used in gas wells, pipe manufacturers, construction equipment manufacturers, sprinkler fire suppression equipment, adhesives and disputes involving purchase orders and steel fabrication
Jerry has published materials on numerous subjects including spoliation of evidence, product defects and consumer conduct, causation in product liability cases, and a component manufacturer's duty to warn. He has also lectured on handling a construction defect case, evidence and trucking claims. His speaking engagements have included presentations at the request of The Defense Research Institute, Pennsylvania Defense Institute, National Business Institute, Pennsylvania Bar Institute and the Philadelphia Association of Defense Counsel.
Jerry is a sustaining member of the Product Liability Advisory Council. By Order of the Pennsylvania Supreme Court, he currently serves on the Pennsylvania Supreme Court Civil Procedural Rules Committee. He has argued cases before the Pennsylvania Superior Court and the Pennsylvania Supreme Court. Jerry is the former Chairman of the Pennsylvania Defense Institute Product Liability Committee.
In law school, Jerry was awarded membership in the Order of the Coif, a National Honor Society, whose membership is limited to the top ten percent of the graduating class and completed a term as a Law Clerk to the President Judge on the Lehigh Court of Common Pleas before starting his career at White and Williams.
Representative Matters
- A multi-million dollar trial involving a prominent window manufacturer and construction defects in over 200 hotels throughout the country
- Summary judgment affirmed by the U.S. Court of Appeals for the Third Circuit in a contract dispute involving steel tubing used in natural gas wells
- Resolution of personal injury and product liability claims brought against manufacturers of high pressure piping and connections
- Negotiated the successful dismissal, without cost to the client, in a wrongful death and survival action, involving bridge construction
- Obtained a judgment in favor of an international chemical company in which independent contractors claimed personal injuries
Recognition & Involvement
Jerry has participated in pro bono activities with the Support Center for Child Advocates and has been specially recognized for his work with the Homeless Advocacy Project.
Jerry was selected in a survey of his peers as a Pennsylvania "Super Lawyer" by Law & Politics magazine in 2004 through 2008. He is AV® rated by the Martindale-Hubbell peer review rating system.
Outside of his law practice, Jerry is a private pilot.News
