Jim Yoder focuses his practice on complex bankruptcy, commercial and insurance litigation. Jim’s extensive litigation experience includes but, is not limited to, cases involving insurance coverage, insured third party liability claims, as well as professional liability claims against directors/officers, attorneys, accountants and insurance brokers/agents. Jim also handles commercial/investment fraud cases, contract disputes, replevin actions, construction contract/defect cases, misappropriation of trade secrets, and partnership/shareholder disputes. 

Jim represents secured/unsecured creditors and interested parties in a broad range of bankruptcy matters including, debtor reorganization/liquidation, creditor claim disputes, executory contract issues, lift stay motions, D&O claims, plan objections, adequate assurance disputes, administrative claims and prosecution/defense of avoidance actions. In bankruptcy court, Jim represents distressed business entities, utility companies, municipal governmental entities, community development districts, school districts, corporate directors and officers, large and mid-size domestic and multinational corporations, insurance brokerage companies, commercial landlords and tenants, equipment lessors, institutional and other lenders, construction companies, aviation companies and trade creditors of virtually every kind. He also represents insurers in asbestos mass tort bankruptcy cases and in other bankruptcy matters affecting insurance companies. 

Jim practices primarily in the state and federal courts of Delaware and Maryland. He is also licensed and actively practices in the state and federal courts of, New Jersey and Pennsylvania. 

Jim is a Mediator, trained under the auspices of the Superior Court of Delaware, and on the panel of approved Mediators/Arbitrators for the U.S. Bankruptcy Court for the District of Delaware. 

Prior to joining White and Williams, Jim was the Managing Director of the law firm of Tighe, Cottrell & Logan, P.A. in Wilmington, DE. He also served as a judicial law clerk to the Honorable George Farrell, III, Superior Court of New Jersey, Salem County. Jim is also a former adjunct faculty member at the University of Delaware Paralegal Certification Program.

  • Represented large financial services consulting company regarding subpoena of several hundred thousand documents by bankruptcy examiner relating to bank failure

  • Regularly represent creditors rights of several major internet advertising companies
  • Prevailed in bankruptcy asset sale objection on behalf of Florida Community Development District
  • Resolved motion to enforce an bankruptcy asset sale agreement on behalf of Community Development District as third party beneficiary
  • Resolved multimillion dollar bankruptcy claim dispute on behalf of Florida Community Development District
  • Represented former executive’s personal interests in an involuntary bankruptcy case against debtor chemical company
  • Defended mortgage brokerage company against bankruptcy trustee’s claim for breach of Loan Purchase and Sale Agreement.
  • Prevailed at trial on administrative expense bankruptcy claim against debtor airline company on behalf of refurbished aircraft component supplier
  • Regularly represent commercial landlord in adequate protection/administrative expense rent bankruptcy claims


  • Defended excess insurer in DJ Action related to mass product liability claims against manufacturer of portable gasoline containers
  • Defended excess insurer in DJ Action related to mass product liability claims against manufacturer of workplace safety equipment
  • Defended excess insurer in DJ Action related to complex environmental claims against poultry producer
  • Defended uninsured motorist benefit carrier in DJ Action arising out of underlying wrongful death claim against intoxicated uninsured driver
  • Rendered insurance coverage opinion to motor vehicle insurer regarding coverage for underlying catastrophic injury claim arising out of unauthorized use of employer provided rental car
  • Regularly provide insurance coverage opinions to insurers relating to construction defect claims
  • Defended CGL insurer in DJ Action by automobile dealer for catastrophic water damage sustained during a roof renovation project
  • Represented insurer in DJ Action regarding insurance coverage for multiple abuse/neglect claims against insured’s child daycare facility
  • Rendered coverage opinion for insurer regarding catastrophic injury claim against insured’s group home for troubled teens


  •  Defended attorney malpractice claim relating to alleged dissipation of testamentary estate’s assets
  • Defended errors and omissions claim relating to alleged wasting of estate assets by bankruptcy claims agent
  • Regularly defend former executives of bankrupt entities in D&O claims by bankruptcy trustees
  • Defended property inspection company in professional responsibility claim by strip mall anchor tenant
  • Defended surety broker in professional responsibility claim by electrical contractor arising from public bidding dispute on high school renovation project
  • Regularly defend insurance agents/brokers against professional liability claims for failure to procure coverage, etc.
  • Regularly defend construction company insureds in on-the-job personal injury claims
  • Defended a raceway facility from a premises liability claim by a motorsport race participant 


  • Obtained cease and desist relief for corporation harmed by misuse of trade secrets by former employee and competitor
  • Defended mortgage brokerage company against breach of Loan Purchase and Sale Agreement claims by assignee bank
  • Regularly prosecute replevin actions on behalf of bank holding purchase money security interests in recreational vehicles
  • Defended a steel fabrication/erection contractor in a complex breach contract claim regarding large scale hospital renovation project
  • Regularly represent steel fabrication/erection contractor in commercial/construction disputes
  • Represented masonry subcontractor against general contractor in breach of contract claim related to construction of office complex
