David Ragonese represents individuals, corporations and government entities in complex insurance and commercial litigation relating to professional liability defense, civil rights defense, consumer fraud, premises liability, construction defect litigation, general negligence, appellate practice and environmental contamination class action defense. 

David handles all phases of civil litigation in State and Federal courts from drafting pleadings, conducting fact and expert discovery, drafting and arguing motions, trial preparation and appeals in the New Jersey Appellate Division and United States Court of Appeals for the Third Circuit.  He has a close and detailed familiarity with the Federal Rules of Civil and Appellate Procedure, including a working knowledge of the Federal District Court’s Electronic Court Filing (ECF) system and a working knowledge of e-discovery including the safe-harbor provision of the Federal Rules of Civil Procedure, protective orders and claw-back agreements.

David has prior experience representing New Jersey municipalities in all areas of municipal law including the MLUL, Local Public Contracts, COAH regulations, Pay-to-Play and labor negotiations.

Prior to joining White and Williams, David served as Deputy Attorney General to the State of New Jersey.  In that capacity, he provided representation and advice to New Jersey Agencies in actions brought under federal and state civil rights statutes, including the Civil Rights Act, the ADA, the CEPA, the NJLAD, the Torts Claims Act and the Contractual Liability Act.

David is an Adjunct Professor of Law at Seton Hall Law School.  He also is a member of the faculty for the National Institute of Trial Advocacy.  David is active in the New Jersey State Bar Foundation’s High School Mock Trial Competition and serves as a judge for the competition in Camden County.

Prior to his legal career, David was a high school Spanish teacher at Camden Catholic High School in Cherry Hill, New Jersey.

Representative Matters

  • Cochran v. Pinchak; represented the State of New Jersey in a constitutional challenge to Title II of the Americans with Disabilities Act which made its way to the en banc panel of the United States Court of Appeals for the Third Circuit
  • McCann v. Winslow Township; represented New Jersey municipality and its police officers in an appeal to the Third Circuit Court of Appeals in a case involving the rights of citizens under the Fourth Amendment
  • U.S. Estates v. Commerce Insurance Services; represented New Jersey licenses insurance producer in a malpractice claim brought by a residential housing developer on an appeal to the New Jersey Appellate Division
  • I/M/O Readoption with Amendments of N.J.A.C. 10A:23, by the New Jersey Department of Corrections, represented the New Jersey Department of Corrections in a constitutional challenge to the procedures for carrying out capital punishment
