The Subrogation-Property Department specializes in property losses and also handles worker’s compensation, healthcare, marine and inland marine subrogation matters.  It provides a wide range of services to the insurance industry, including early site investigation directed toward protecting the carrier’s subrogation interests and the attorneys litigate subrogation actions throughout the eastern seaboard.  Additionally, there are lawyers within the department who focus their practice on complex coverage disputes and the defense of insureds under third-party liability policies.

Subrogation

The subrogation practice group offers a unique program designed to maximize recovery prospects through early intervention and aggressive litigation of claims.  The initial professional services of our subrogation attorneys are provided at no cost to the client, and include: identifying potential defendants and providing notice of a claim against them, coordinating site investigations by our experts and by representatives of potential defendants, identifying and collecting pertinent documents, locating and interviewing witnesses, and properly preserving evidence so that spoliation problems are averted.  We also have access to scientists and forensic experts in every discipline.  We will coordinate the investigative tasks undertaken by the expert to ensure completeness, while remaining mindful of cost.  If the subrogation claim is pursued we will handle it on a contingency fee basis so that our clients pay a fee only if we make a recovery.  The subrogation practice covers the entire eastern seaboard, Maine to Florida.

First Party Coverage

Our first party coverage team brings a broad range of skills and experience to the evaluation, analysis, and litigation of complex coverage disputes arising out of property losses.  The matters handled by our coverage team include all types of losses under policies providing property coverage, including, but not limited to, fire, theft, machinery and equipment failures, weather related losses, and construction site accidents.  Our expertise also includes defense of first party bad faith claims.

Third Party Defense

This department also has broad experience in defending against a wide variety of claims covered by liability policies.  Our specialty is the defense of property damage claims that arise from negligence, contractual and warranty disputes, and products liability.  We are available to defend third party claims in Pennsylvania, New Jersey, and Delaware.
