Our Experience

The Healthcare Law Group of White and Williams LLP provides a broad range of legal services to healthcare providers in the region and adjoining states.   In connection with the handling of professional liability claims, we represent a number of hospitals and health systems throughout Pennsylvania and in the states of Delaware and New Jersey, including community facilities and teaching institutions.  Our clients include entities that are covered by professional liability policies and those that are self-insured.  We also provide representation for a variety of individual clients including physicians, nurses, and allied healthcare providers in the defense of professional liability claims.

Our attorneys have represented pharmaceutical companies in DES, DPT and AIDS litigation as well as defending claims involving prescription pharmaceuticals and over-the-counter products.  In addition, the group has done a substantial amount of defense work for medical device manufacturers.  These services are performed on a regional and national basis.  We also represent many healthcare providers in diet-drug cases and Breast Implant litigation, for which our firm serves as statewide liaison counsel for healthcare defendants.

Our representation of healthcare providers includes not only the defense of malpractice claims, but also general representation and counseling in various areas of healthcare law.  We handle administrative and court proceedings involving licensure issues, staff privileges and credentialing, contracts for exclusive providing of services and the anti-trust implications of same.  Our representation includes healthcare anti-trust claims involving allegations of boycott and conspiracy in restraint of trade, Medicare and Medicaid fraud and abuse, R.I.C.O. and other claims brought against healthcare providers by competitors and potential competitors.  With respect to individual healthcare providers, we are involved in the formation of professional corporations, the creation of qualified benefit plans, the drafting of partnership agreements among medical and non-medical professionals and individual tax and estate planning.

Attorneys in the group prepare and present emergency medical petitions for court approval, give advice to hospital administration and staff members concerning HIPAA compliance, "Do Not Resuscitate" orders, AIDS testing, guardianships and similar medical/legal issues.  Members of our group also serve on the Ethics Committees of several hospitals.  We regularly provide advice and counseling regarding by-laws and related corporate documents for healthcare institutions and have drafted medical staff guidelines, rules and regulations, by-laws and related hospital policies.  Our extensive experience in representing hospitals as well as physicians and allied health professionals gives us unique expertise in terms of institutional issues, including hospital/medical staff relationships, physician group structures, personnel, insurance coverage, and risk management issues.

Our attorneys provide advice to home health agencies and have considerable expertise in representing assisted living and continuing care facilities which typically contain a state-licensed nursing facility.  We have been involved extensively with Departments of Insurance and other appropriate regulatory agencies having jurisdiction over the development of new life care communities and the operation of existing facilities.

In addition to the foregoing matters, the Healthcare Law Group is involved in handling transactional matters for healthcare providers from a variety of perspectives. We have drafted employment, joint venture and exclusive contracts for hospitals, ambulatory care facilities, physicians and allied health professionals.  We regularly review and have also participated as bond counsel and in other capacities in a number of transactions involving the financing and/or construction of hospitals, convalescent homes, medical office buildings and nursing homes.  In conjunction with our Labor/Employment Group we provide a broad range of employment and personnel advice relative to the problems encountered by healthcare providers, including issues relating to AIDS, substance abuse and labor relations for institutions with both unionized and non-unionized work forces.
